After Subhash’s tragic suicide, his mother files a habeas corpus petition as the whereabouts of her 4-year-old grandson remain unknown.
December 20, 2024: In a deeply unsettling case, Anju Modi, the mother of Bengaluru engineer Atul Subhash, who died by suicide on December 9, has filed a habeas corpus petition with the Supreme Court. Modi is seeking the custody of her four-year-old grandson, whose location remains a mystery following the tragic incident.
Subhash left behind a video and written notes alleging harassment and false accusations from his wife, Nikita Singhania, and her family, which he claimed pushed him to end his life.
Child’s Whereabouts Unknown
Anju Modi alleges in her petition that neither Nikita nor her family, currently in judicial custody, have disclosed the boy’s location. Nikita reportedly informed the police that the child is enrolled in a Faridabad boarding school under the care of her uncle, Sushil Singhania. However, Sushil has denied any knowledge of the child’s whereabouts.

In response, a Supreme Court bench led by Justice BV Nagarathna and Justice N Kotiswar Singh has issued notices to the governments of Uttar Pradesh, Haryana, and Karnataka to clarify the situation. The next hearing is scheduled for January 7, 2025.
Arrests and Legal Developments
The case has already seen significant legal action. On December 16, Nikita, her mother Nisha Singhania, and brother Anurag Singhania were arrested and charged with abetment of suicide based on Subhash’s notes and video evidence.
Meanwhile, Sushil Singhania, 69, sought anticipatory bail in the Allahabad High Court, citing health conditions and arguing that accusations against him were exaggerated. Justice Ashutosh Srivastava granted him pre-arrest bail with conditions, including a ₹50,000 personal bond, mandatory availability for police interrogation, and surrendering his passport.
Family’s Plea for Justice
Subhash’s family has expressed deep anguish over the incident and vowed not to immerse his ashes until they secure justice. His brother, Bikas Kumar, stated, “We will not immerse the ashes of my brother till we get justice. Our fight will continue.”
The family is equally concerned about the safety and well-being of Subhash’s son. “I am very worried about my nephew’s safety. We have not seen recent photographs of him and want to know his whereabouts. We demand custody as soon as possible,” Bikas added.
