Saif Ali Khan Stabbing Case: Accused Mohammad Shariful Islam Moves Court to Declare His Arrest Illegal

May 10, 2025: Mohammad Shariful Islam, the accused in the high-profile stabbing case of actor Saif Ali Khan, has withdrawn his bail plea and filed a fresh application claiming that his arrest was illegal. Currently lodged at Mumbai’s Arthur Road Jail, the 30-year-old Bangladeshi national appeared before the Judicial Magistrate First Class (Bandra) on Friday to challenge the legality of his detention.

According to his plea, the arrest violated Section 47 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), which mandates that a person be informed of the grounds of arrest and the right to bail at the time of their detention. His lawyer, Ajay Gawli, argued that the police failed to provide these details in writing, and no records exist to prove that these mandatory provisions were followed.

The sessions court had been considering Islam’s bail plea, filed last month, but he withdrew it before shifting focus to the legality of the arrest. The court has now directed the police to respond to the plea and adjourned the matter to May 13.

The incident took place on January 16, when an intruder allegedly stabbed Saif Ali Khan multiple times inside his Bandra apartment. The 54-year-old actor underwent emergency surgery and was discharged after five days.

The case continues to draw public attention due to the violent nature of the crime and the high-profile victim involved.
