
SC Upholds Teen’s Right to Abort at 30 Weeks
Apex court says no woman can be forced to continue pregnancy against her will
February 6, 2026: In a landmark judgment reaffirming reproductive autonomy, the Supreme Court allowed a teenager to terminate her 30-week pregnancy, clearly stating that no woman can be compelled to continue a pregnancy against her wishes. A bench led by Justice BV Nagarathna set aside a Bombay High Court order that had denied permission for medical termination and suggested adoption instead, calling such an approach inconsistent with a woman’s fundamental right over her own body.
The petitioner, who conceived at 17 and is now 18 years old, approached the apex court after her pregnancy reached an advanced stage. The Supreme Court noted that forcing her to carry the pregnancy to term could cause severe mental and physical trauma. It clarified that whether the relationship leading to pregnancy was consensual was irrelevant, as the central issue was the woman’s clear refusal to continue the pregnancy.
After examining the medical board’s report, the court found no grave risk in terminating the pregnancy and ruled in favour of the teenager’s choice. Justice Nagarathna also raised broader concerns about rigid timelines under the MTP Act, warning that delays often push women towards unsafe alternatives. The ruling reinforces that reproductive choice, dignity, and mental well-being must take precedence in such sensitive cases.
