
"Why Don’t You Want Probe?" Karnataka HC Questions Techie Atul Subhash’s Wife Amid Suicide Case
January 6, 2025: The Karnataka High Court on Monday rejected a plea by Nikita Singhania to cancel the First Information Report (FIR) filed against her in connection with the alleged suicide of Bengaluru techie Atul Subhash. The case revolves around accusations of harassment and a demand of ₹3 crore by Nikita as part of a divorce settlement, which reportedly drove Atul to take his own life.
During the hearing, Justice SR Krishna Kumar remarked that the FIR contains sufficient grounds to proceed with the investigation under abetment to suicide. The bench questioned Ms. Singhania’s reluctance to allow the probe, stating, “Why don’t you want the investigation to happen? The prima facie ingredients of the offence are made out in the complaint.”

The counsel for Nikita Singhania argued that the FIR lacked substantial evidence to establish a direct link between her actions and Atul’s suicide. They further emphasized that filing a legal complaint against Atul shouldn’t automatically result in an FIR under abetment to suicide.

Atul’s family accused Nikita of demanding ₹3 crore as part of a divorce settlement and repeatedly harassing him emotionally and financially. They claimed that during court proceedings, Atul was taunted and pressured to either pay the settlement or end his life.
Atul’s brother, Bikas Kumar, had lodged a complaint under Sections 108 and 3(5) of the Bharatiya Nyay Sanhita (BNS), alleging consistent mental harassment by Nikita and her family.
Earlier, a Bengaluru court had granted bail to Nikita Singhania, her mother Nisha Singhania, and her brother-in-law Anurag Singhania. However, Atul’s family expressed dissatisfaction with the bail decision and indicated their intent to appeal in the Karnataka High Court.
Atul’s father, Pavan Kumar Modi, raised concerns about the safety of his grandson, alleging that Nikita could potentially harm the child. He also highlighted continuous financial demands made under the pretext of child care. The family is reportedly planning to approach the Supreme Court for the child’s custody.
The High Court has directed the prosecution to submit all materials collected during the investigation and issued notices to the respondents.
