In a major legal blow, a California jury has ordered Starbucks to pay $50 million (approximately ₹434.78 crore) in damages to a delivery driver who suffered severe burns after a hot beverage spilled on him at a Los Angeles Starbucks drive-through.

What Happened?

  • The incident occurred on February 8, 2020, when Michael Garcia, a delivery driver, picked up an order at a Starbucks drive-through in Los Angeles.
  • One of the hot drinks was improperly secured in the drink carrier, causing it to fall onto Garcia’s lap, resulting in third-degree burns, nerve damage, and permanent disfigurement.
  • According to Garcia’s legal team, the injuries have significantly affected his quality of life, both physically and emotionally.

Jury’s Decision and Starbucks’ Response

  • The jury found Starbucks liable, citing:
    • Negligence in securing hot beverages
    • Physical and emotional distress caused to Garcia
    • Long-term impairment due to burns
  • Starbucks disagreed with the ruling and announced plans to appeal the verdict.
    • Company spokesperson Jaci Anderson stated:
      “We sympathize with Mr. Garcia but disagree with the jury’s decision. The damages awarded are excessive. Starbucks has always maintained the highest safety standards in handling hot drinks.”

Garcia’s Legal Team on the Verdict

Garcia’s attorneys argue that Starbucks failed in its duty of care, stating:

Starbucks Rejected a $30 Million Settlement Over an Apology

Before the trial, Starbucks had offered to settle the case:

  • Initial offer: $3 million (₹26 crore)
  • Revised offer: $30 million (₹261 crore)

However, Garcia was only willing to accept if Starbucks issued a public apology, changed its safety policies, and ensured that employees double-check the security of hot drinks before serving customers. Starbucks refused these terms, leading to the case going to trial.

Comparisons to the Famous McDonald’s Coffee Case

This case is drawing comparisons to the landmark 1994 McDonald’s lawsuit, in which Stella Liebeck suffered third-degree burns from spilled coffee and was initially awarded nearly $3 million in damages. That case led to significant changes in how food and beverage companies handle hot drinks.
