Donald Trump Becomes First Felon US President, Avoids Jail Due to Presidential Immunity
January 11, 2025: Washington DC: Donald Trump today made history as the first sitting or former US President to be sentenced as a felon after a court upheld his conviction in the hush money case involving adult film actress Stormy Daniels. Despite his conviction on 34 counts of falsifying business records, Trump has been granted “unconditional discharge,” ensuring he faces no jail time or penalties.

The decision is rooted in Trump’s status as President-elect, preparing to take the oath of office on January 20, which accords him immunity due to the constitutional protection granted to the highest office in the land. Trump will now return to the White House for a second term, despite the felony conviction.
The sentencing was delivered by New York Judge Juan Merchan, who noted the unique and unprecedented circumstances of the case. “The only lawful sentence that permits a judgment of conviction without infringing on the highest office of the land is an unconditional discharge,” Judge Merchan stated.
The judge acknowledged that had Trump not been President-elect, his crimes could have carried a prison term of up to four years. However, the constitutional safeguards around the Presidency left the court with no other viable option.
Trump attended the court session virtually, seemingly confident of the outcome. Speaking ahead of the sentencing, he described the legal proceedings as a politically motivated attack designed to harm his reputation ahead of the election.
“It was done to damage my reputation, just so I may lose the election,” Trump said, calling the experience “terrible” and criticizing the New York court system.
The case revolved around Trump’s alleged efforts to silence Stormy Daniels through illicit payments during the 2016 Presidential election campaign. Daniels testified in detail about her alleged encounter with Trump in a Nevada hotel and the subsequent payment cover-up.
This sentencing marks an unprecedented moment in American history, with Trump becoming the first convicted felon to ascend to the Presidency. The situation raises questions about the intersection of Presidential immunity and accountability.
Despite numerous legal challenges, including a Supreme Court ruling that allowed the sentencing to proceed, Trump has successfully avoided prison due to his electoral victory and constitutional protections.
The sentencing, coming just ten days before Trump’s inauguration for a second term, has ignited heated debate across political and legal circles. Critics argue that the ruling undermines the justice system, while supporters view it as a vindication of Trump’s claims of political bias.
