June 30, 2026: The Supreme Court on Tuesday declined to entertain a petition seeking a Central Bureau of Investigation (CBI) probe into the alleged encounter killing of Bharat Bhushan Tiwari in Bihar’s Bhojpur district. A Bench comprising Justice MM Sundaresh and Justice Sheel Nagu directed the petitioner to approach the jurisdictional High Court, stating that the matter should first be examined there. The court did not comment on the merits of the allegations while disposing of the plea.

The petition, filed by Supreme Court advocate Vishal Tiwari, sought a court-monitored CBI investigation into the encounter. It also requested the formation of an independent expert committee headed by a retired Supreme Court judge to examine the circumstances surrounding Bharat Bhushan Tiwari’s death. Additionally, the petitioner urged the court to direct the registration of an FIR against the police personnel allegedly involved in the incident.

The petitioner claimed that Bharat Bhushan Tiwari’s death was not a genuine police encounter but amounted to murder, arguing that only an independent investigation could establish the truth and ensure accountability. However, the Supreme Court declined to examine these claims at this stage and advised the petitioner to pursue appropriate legal remedies before the concerned High Court.
