The Delhi High Court said it is for the Centre, and not the judiciary, to decide whether a case should be referred to the National Investigation Agency.
July 24, 2026: The Delhi High Court on Friday dismissed as withdrawn a public interest litigation (PIL) seeking an NIA or other specialised agency probe into the Cockroach Janta Party (CJP)-led ‘Chalo Sansad’ march held on July 20 over the alleged NEET-UG paper leak. A Bench comprising Chief Justice D.K. Upadhyaya and Justice Tejas Karia observed that any allegations of vandalism had already come to the notice of the authorities, who would take action in accordance with the law. The court also clarified that it is the Centre—not the judiciary—that decides whether a case should be referred to the National Investigation Agency.
Following the court’s observations, Solicitor General Tushar Mehta suggested that the petitioner withdraw the PIL. The petitioner, Satish Kumar Aggarwal, subsequently sought permission to withdraw the plea, which the court allowed. The petition had alleged that the participation of political leaders and organisations receiving foreign funding raised concerns over the nature and purpose of the protest, warranting an impartial investigation and registration of an FIR.
The Cockroach Janta Party has been protesting since June 20, demanding the resignation of Union Education Minister Dharmendra Pradhan over alleged examination irregularities. On July 20, thousands of protesters gathered at Jantar Mantar before attempting to march towards Parliament during the Monsoon Session. The demonstration led to clashes between protesters and police, with authorities using lathi charges and tear gas to disperse the crowd, leaving several protesters and police personnel injured.
