The US Supreme Court rejected President Donald Trump’s executive order, ensuring children born in America continue to receive automatic citizenship
July 1, 2026: The US Supreme Court has struck down President Donald Trump’s attempt to restrict birthright citizenship, delivering significant relief to Indian students, professionals, and immigrant families living in the United States. In a 6-3 ruling, the court rejected an executive order signed at the start of Trump’s second administration that sought to deny automatic US citizenship to children born to parents who were in the country illegally or were present temporarily on visas. The decision preserves the constitutional guarantee of birthright citizenship under the Fourteenth Amendment.
The ruling is particularly important for the Indian-American community, as hundreds of thousands of Indians reside in the US on H-1B, L-1, and F-1 visas while more than one million remain stuck in the employment-based green card backlog. The judgment ensures that children born in the US to Indian parents on temporary work or student visas, as well as those born to undocumented Indian immigrants, will continue to receive automatic American citizenship. India is the second-largest immigrant community in the US, with an estimated 3.2 million documented immigrants and around 725,000 undocumented Indians.
Indian-American leaders welcomed the verdict, calling it a reaffirmation of constitutional protections for immigrant families. Indian American Impact Executive Director Chintan Patel said the decision protects families whose children are born in the US while their parents wait years for permanent residency. Congressman Raja Krishnamoorthi also praised the judgment, stating that the Supreme Court had reaffirmed the Fourteenth Amendment’s guarantee of equal citizenship and made it clear that constitutional rights cannot be altered through executive orders.
