Court rules appeal to be decided on existing records in Kuldeep Sengar case

April 22, 2026: The Delhi High Court on Wednesday dismissed a plea filed by the Unnao rape survivor seeking to introduce additional evidence to establish her age through school records. A bench comprising Prathiba M Singh and Madhu Jain held that the matter should be decided based on the evidence already available on record.

The survivor had sought permission to further examine two witnesses from her school in Uttar Pradesh, including the principal and a teacher. However, the court noted that the school had already clarified that no birth certificate or related documents were submitted at the time of admission, as it was not required under prevailing practices. It also observed that the principal had previously testified before the trial court and relevant records had been produced, leaving no need for additional evidence at this stage.

The plea was filed in connection with the appeal of expelled BJP leader Kuldeep Singh Sengar, who was convicted in 2019 for raping a minor in Unnao and sentenced to life imprisonment. The High Court emphasised that the appeal would proceed on the basis of existing material, while the case continues to remain under judicial scrutiny following earlier interventions by the Supreme Court.
