A woman from Rajasthan’s Banswara district has approached the police after allegedly receiving a triple talaq notice from her husband through WhatsApp while he was residing in Kuwait.

Police have registered a case and initiated an investigation into the allegations, officials confirmed.

According to the complaint filed at the Women’s Police Station in Banswara, the woman alleged that her husband, Ashiq Iqbal, ended their marriage by sending a triple talaq message to her WhatsApp number on May 17. The accused, a resident of the Gorakh Imli area, has reportedly been working in Kuwait for the past year.

Women’s Police Station SHO Urmila said that a case has been registered based on the complaint and legal proceedings have been initiated. Authorities will issue a notice to the accused and seek his response as part of the investigation.

Woman Alleges Years Of Physical And Mental Harassment

In her written complaint, the woman alleged that she had been subjected to physical and mental harassment by her husband for several years.

She claimed that whenever her husband returned to India from Kuwait, relations would remain cordial only for a brief period before he allegedly began harassing and assaulting her over minor issues.

According to the complaint, the abuse continued during his visits to India, resulting in repeated incidents of physical violence and mental distress.

The woman further stated that she has been living separately in Banswara with her two sons, aged 16 and 10. She alleged that she has been raising the children on her own while staying away from her husband’s family members, including her mother-in-law and sister-in-law.

WhatsApp Message Triggered Police Complaint

The complainant told police that she decided to seek legal action after receiving a WhatsApp message in which her husband allegedly pronounced triple talaq.

Following the complaint, police registered a case and began recording statements from the concerned parties. Since the accused is currently residing abroad, officials said due legal procedures will be followed to obtain his response and proceed with the investigation.

Triple Talaq Remains Punishable Under Indian Law

The case has attracted attention because the practice of instant triple talaq has been declared unconstitutional in India.

In 2017, the Supreme Court struck down instant triple talaq, ruling it unconstitutional. Subsequently, Parliament enacted the Muslim Women (Protection of Rights on Marriage) Act, 2019, which criminalised the practice and made its pronouncement a punishable offence under Indian law.

Police officials said the investigation is ongoing and further action will be taken based on the findings of the inquiry.
