Prime Minister Narendra Modi’s recent appeal encouraging companies to adopt work-from-home (WFH) practices amid rising fuel costs and global economic uncertainty has reignited debate across corporate India. But despite the strong message, legal experts say employers are still not obligated to allow remote work unless it is part of company policy or employment agreements.

Speaking in Secunderabad, PM Modi urged citizens and businesses to revive Covid-era habits such as online meetings, virtual collaboration, and reduced travel to help conserve fuel and reduce pressure on the economy during the ongoing West Asia crisis.

However, India currently has no dedicated law that gives employees a universal legal right to work from home.

What Do Indian Labour Laws Say?

According to labour law experts, attendance rules and workplace arrangements in India are still largely controlled by employment contracts, HR policies, and state-level Shops and Establishments Acts. While the new labour codes acknowledge remote and hybrid work models, they allow such arrangements only through mutual agreement between employers and employees.

This means companies still have the authority to decide whether staff should work remotely, follow hybrid schedules, or return fully to office.

Why WFH Was Mandatory During Covid

During the Covid-19 pandemic, work-from-home became enforceable because the government invoked emergency powers under the Disaster Management Act and Epidemic Diseases Act. Offices were legally directed to operate remotely wherever possible.

At present, no such mandatory government notification exists. PM Modi’s comments are therefore considered an advisory measure rather than a legally binding instruction.

Can Employers Force Staff Back To Office?

In most cases, yes.

Indian companies generally retain managerial control over workplace policies, reporting structures, and office attendance requirements. Unless remote work has been contractually guaranteed, employers can legally require employees to return to office.

Many firms across IT, consulting, banking, media, and corporate sectors have already implemented hybrid or full return-to-office policies over the past two years.

Are There Any Exceptions?

Certain categories of employees may still seek flexible work arrangements under specific laws. For example:

  • The Rights of Persons with Disabilities Act allows reasonable workplace accommodation.
  • The Maternity Benefit Act permits eligible women to work from home after maternity leave if the nature of work allows it.

Still, these provisions do not create a blanket right to remote work for all employees.

Why PM Modi’s Message Matters

Even without legal force, the Prime Minister’s remarks carry economic and political significance. His repeated emphasis on fuel conservation, reduced foreign travel, domestic spending, and remote work signals growing concern over rising crude oil prices, pressure on foreign exchange reserves, and inflation risks linked to the global crisis.

Experts believe that if fuel shortages or economic disruptions worsen, the government could introduce stronger advisories or even temporary restrictions encouraging remote work in sectors capable of operating digitally.

For now, though, the final decision on WFH remains with employers.
